Filing a DMCA Notice

To file a DMCA notice, please provide a written communication containing the following details:

  • A physical or electronic signature of the copyright owner or an authorized representative.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.
  • Your contact information, including your address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-Notification (For music promoters)

If you believe that your content was removed by mistake or misidentification, you may file a counter-notification. Your counter-notification should include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and its original location.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, the judicial district in which MackNaija is located) for any litigation arising out of your submission.

Process

Upon receipt of a valid DMCA notice, MackNaija will act expeditiously to remove or disable access to the infringing material. We will also forward your notice to the member who provided the allegedly infringing material.

If a counter-notification is received, MackNaija may reinstate the removed material unless the original complainant files a court action against the party filing the counter-notification within 10 business days.

Repeat Infringers

Under the DMCA, MackNaija has a policy for terminating, in appropriate circumstances, users who are repeat infringers. We reserve the right to remove or disable access to any content that we determine, in our sole discretion, may constitute a repeat infringement.
